PRIVACY STATEMENT DATA COLLECTED FROM DATA SUBJECT

Information pursuant to Art. 13-14, Reg EU 2016/679 (European Data Protection Regulation)

Foreword

Bardolino Rent Boats SRL, with registered office in Via Ugo Foscolo, 8/13 – 37011 Calmasino di Bardolino, (VR), Data Controller of the personal data already communicated or that will be communicated in the future and where the personal data are or will be collected, wishes to inform you that the EU Regulation 2016/679 (“European Data Protection Regulation”) provides for the protection of persons and other subjects and the respect of the processing of personal data. Pursuant to Articles 13 and 14, we therefore provide the following information:

1 – Purpose, legal basis of the processing for which the data are intended
All personal data communicated by the data subject (personal details, traditional postal addresses, telephone numbers, e-mail addresses, tax code) may be processed for the following purposes:

• signing and execution of contracts;
• the management of electronic invoices and credit notes;
• accounting and vat management;
• the management of receipts and payments;
• comply with specific requests of the person concerned.

The lawfulness of the processing of personal data derives from the execution of a contract to which the data subject is a party or from the execution of pre-contractual measures taken at the request of the data subject and from the necessity to comply with a legal obligation (laws and regulations of the State, EU regulations) to which Bardolino Rent Boats SRL is subject.

2 – Method of processing
The processing of personal data takes place at the offices of Bardolino Rent Boats SRL or, if necessary, at the premises of the subjects listed in paragraph 4, using both paper and computer media, also by means of automated tools suitable to store, manage and transmit the data, with the observance of all precautionary measures which guarantee security and confidentiality. Processing will be carried out in such a way as to minimise the risk of destruction or loss, unauthorised access, and processing that is not in accordance with the purposes for which the data were collected. Personal data are processed in accordance with the principle of minimisation, pursuant to Articles 5 paragraph 1 letter c and 25 paragraph 2 of the Regulation. Therefore, they are processed lawfully and fairly, they are collected for specific, explicit and legitimate purposes, they are accurate and if necessary updated, they are relevant, complete and not excessive in relation to the purposes of processing.

3 – Compulsory or optional nature of provision
The provision of personal data is not mandatory, but refusal to provide it may make it impossible or extremely difficult to provide the services requested.

4 – Scope of communication and dissemination of data
Personal data may be communicated:

• to persons whose right of access to the data is recognised by national law, by the European Union, and to the police;
• to our collaborators, employees, within the scope of their duties;
• to banking institutions for the management of collections and payments arising from the execution of contracts;

 5 – GPS tracking service
Localisation is carried out exclusively for the purpose of checking the position of the boat; its use is strictly necessary for work, to ensure safety during navigation and intervention in case of need.

6 – Rights of the data subject
Please note that you may exercise the following rights at any time:

• right to obtain access to one’s personal data;
• the right to have one’s personal data corrected or deleted where this does not contravene current data retention legislation;
• right to obtain the restriction of processing of one’s personal data;
• right to data portability;
• the right to object at any time, on grounds relating to their particular situation, to the processing of their personal data;

 The data subject may exercise the above rights by making a request to the data controller without formalities by e-mail to [email protected]. To facilitate the exercise of these rights, the Italian Data Protection Authority has drawn up a specific form that can be downloaded from the website www.garanteprivacy.it.

7 – Modalities, place and duration of personal data storage
The personal data of the data subject shall be processed for the period necessary for the performance of the rental service at the registered office of the Controller; according to the terms established by law and in any case no longer than is necessary for the management of the service itself. At the end of the service provided, the data will be stored at the Controller’s registered office and deleted within a week.

8 – Right to lodge a complaint
The data subject is hereby informed that he/she has the right to lodge a complaint with a supervisory authority (in particular the Italian Data Protection Authority)
